1. Websites and operator
These terms govern access to The Artifics and Guester marketing websites, website content and contact/demo enquiries. The Artifics is the main brand; Guester is its hotel software product. In this pre-formation version, The Artifics is the service brand; the actual operator’s legal identity is disclosed when the company/operator arrangement is completed. This version is for pre-formation information and review. Contact: info@theartifics.com. Brand use does not establish the existence of an unformed legal entity or the formation of a service agreement.
The hotel panel service relationship is formed under the separate Guester Terms of Service and accepted document bundle. These website terms do not create accommodation sales or general authority to act for a hotel. Viewing a website or requesting a demo does not constitute paid subscription or Founding Hotel acceptance.
2. Nature of content
The website may contain product descriptions, example screens, articles, events and contact information. Demo and sample data are not presented as actual hotel results. A feature's appearance in marketing does not itself enable it for every user or include it in an agreement; account scope is determined separately before acceptance.
Development plans may change. Claims of guaranteed revenue growth, universal compatibility, legal compliance, uptime or certification can be assessed only if expressly stated within a verified scope. General content is not personalised professional advice addressing the user's own legal, tax or operating obligations.
3. Permitted use
Users may access the website normally, read promotional content for personal or their own business evaluation and make enquiries with accurate information. Content rights are not assigned to the user. Statutory rights and, where necessary, permission from the right holder apply to use of website names or images.
Sending malware or misleading enquiries, compromising security, acting without permission using another person's information, overloading servers and unlawful personal data collection are prohibited. Statutory use exceptions remain applicable. Security issues are reported directly through the contact channel without unnecessary personal data disclosure.
4. Intellectual property and links
Rights in brands, articles, designs, images and software are protected to the extent held by the relevant right holders. Open-source and third-party elements remain subject to their own licences. Unauthorised republication, implying association with the service to offer something else and misleading brand use are prohibited.
A third-party link does not endorse all linked content or assume all provider obligations. External services have their own terms. The operator takes reasonable steps to correct known material errors in its own links and descriptions.
5. Demos, contact and marketing
Demo and contact enquiries are used to assess and answer the request. Submitted information should be accurate and limited to what is needed; guest lists, passwords, card data and sensitive records should not be sent through a general website form. An appropriate secure channel is specified separately if special data sharing is needed.
Answering a request does not create an ongoing marketing subscription without any necessary additional permission. Where required, marketing choices are offered separately and optionally. Permissions and refusals are not bundled with contract acceptance. Pilot participation, logo use and actual account activation each follow their own express-acceptance process.
6. Privacy and cookies
Visitor and enquiry purposes, legal grounds, recipients and rights channels are explained in the Privacy/KVKK Notice. The Cookie Notice and accessible preference controls govern relevant website technologies. Viewing the website is not explicit consent to all cookies or transfers.
Accessing a notice or acknowledging it has been read does not approve the activities described. Non-essential choices are managed separately from the service agreement. Product-panel data flows and marketing-site forms/technologies are not assumed identical; the relevant notice identifies its scope.
7. Availability and liability
The operator exercises reasonable care to keep the website secure and accurate. Maintenance, technical issues and external-service interruptions may affect access. Updating website content alone does not vary a Customer service agreement. Before important decisions, visitors should check the offered scope and current conditions.
Liability is governed by applicable law; intentional misconduct, gross negligence and non-excludable liability are not removed. These website terms do not reduce service Customers' DPA or SaaS rights. Access restrictions following a breach must be proportionate to actual risk.
8. Updates and law
Version: 3.3. Updated: 13 October 2026. Updated website terms display their date and version and do not apply retrospectively to previously accepted product agreements. Legally required acceptance or formalities are completed separately. Published operator channels are used for contact and notices.
Turkish law and courts with statutory jurisdiction apply to website use within Türkiye, preserving mandatory local rules. Consumer rights, access to data protection authorities and other mandatory rights are not obstructed. Exclusive venue is not assumed without a separate valid agreement.
