Founding Hotel Program Terms

Three calendar months of free use from activation, with no automatic paid conversion.

Version 3.3Document date:

The Founding Hotel Program lets eligible hotel operators evaluate accepted Guester modules in real workflows and provide voluntary feedback. The service is offered under The Artifics brand. The program creates no partnership, investment, agency, franchise, exclusivity or equity acquisition; the hotel operator remains independent.

These terms are accepted with the Terms of Service, Service Description, DPA, Support and Service Level Agreement (SLA) and applicable AI and Automation Authority. Mutual confidentiality is covered by the Terms of Service; free participation does not reduce personal data processing and protection obligations.

The program applies only to hotels whose accounts display the Founding Hotel plan and whose operator details and representative authority are verified. Before acceptance, the authorised person can access the program summary and document links and selects an initially unchecked contract box to complete acceptance. No signature, Customer-completed blank fields or separate paper order form is required inside the agreement.

The operator, property, account administrator, selected modules, program scope and accepted versions are linked to account records. Acceptance and service activation are separate events. Account creation, viewing a demo or joining a waitlist does not itself start the three-month period. Relevant functions are not activated until missing authority or necessary data arrangements are completed.

Free use lasts three calendar months from the date and time the accepted pilot scope is made accessible and notified in the activation record. Commencement, expiry and time zone are displayed in the account program summary. The period is not converted into ninety days. It ends at the same date and time in the third following month; if that month lacks the date, the same time on its final day applies.

Time before activation due to implementation, contractual or legal data requirements does not consume the free period. If only limited scope is activated, that scope and commencement are disclosed; the record does not suggest every module is available. A material inability to use the service caused by the Provider is assessed for an appropriate remedy or extension; an accepted extension appears in the account record and Customer copy.

The accepted Guester service price is zero for the three-month program period. Included properties, modules and usage are defined in the acceptance summary. The Provider does not charge hidden fees or cancellation penalties for ordinary pilot use, standard support or program exit. A credit card or commitment to a future paid subscription is not a participation requirement.

The program does not remove fees the hotel pays under its own PMS, OTA, email or other third-party agreements. Any additional service, implementation or third-party usage cost to be collected through Guester is shown with amount and scope and expressly accepted in advance. Unapproved additional usage is not converted into a paid order; the relevant additional function may instead be restricted.

The hotel may evaluate the service with authorised users appropriate to its workflows and report faults or suggestions through support. Feedback is voluntary; continuing participation is not conditional on positive public reviews, promotional sharing, references or a stated satisfaction level. Honest hotel criticism within confidentiality and lawful disclosure boundaries is not penalised.

Use of a name, logo, screenshot, case study or promotional founding-partner designation requires separate, specific permission. The general contract box is not advertising permission. Suggestions containing Customer secrets or personal data cannot be published freely under the general feedback licence. The Provider does not turn pilot results into guaranteed revenue increases or unverified success claims.

Actual PMS and personnel data may be used only within the DPA, disclosed recipients, processing purposes and necessary transfer arrangements. Public reviews may also be personal data where people can be identified. Servers in Türkiye do not automatically eliminate flows to Cloudflare, Gemini or other foreign recipients. Hotel acceptance does not replace guest or employee consent or official transfer instruments.

General pilot acceptance does not enable external messages, review responses or Channex rate/availability changes. Function-specific authority, property mapping and human approval are determined separately. AI outputs are checked and wrong-property content is not sent. Review gating, fake reviews, unverified personnel judgments and treating OTA offers as realised ADR are not accepted program operation.

The three-month program never converts automatically into a paid subscription. The Provider may make a continuation offer; paid service or collection begins only after price, taxes, scope, period, renewal and cancellation conditions are shown and a new paid order is expressly accepted. Silence, logging in on the last pilot day or earlier contract acceptance is not acceptance of paid continuation.

If paid continuation is not accepted, pilot service ends at program expiry and retrieval, return and deletion follow the DPA. The Customer is informed of expiry and available exit methods. A new order does not retrospectively charge for the old free pilot. The new subscription period and authority appear in a separate account/order record.

The Customer may end the pilot at any time without penalty using account cancellation or info@theartifics.com. Cancellation is recorded and an available data-retrieval route explained. The Provider may apply proportionate suspension and termination under the Terms of Service for security, illegality, unauthorised representation or material breach; free use does not remove confidentiality or data protection.

The Terms of Service liability limits apply: USD 1,000 general liability and USD 2,000 for personal data and confidentiality breaches during the free pilot. Intentional misconduct, gross negligence and liabilities that cannot lawfully be limited are excluded from these caps. The pilot may include experimental features; that does not remove professional care and disclosure obligations.

Confidentiality, personal data protection, legally continuing retention and return/deletion obligations survive program expiry as necessary. Individual participation is governed by the accepted account scope. This text contains no Customer-completed fields; account details and program records are incorporated.

Version: 3.3. Updated: 13 October 2026. The Customer's accepted version applies to its three-month program. A material adverse change is not accepted through silence. These program terms retain precedence on program duration and price; the Terms of Service govern other matters and the DPA governs personal data.
